2. Purpose and scope
These terms govern the contractual relationship between JAGGER ESTILISTAS and customers purchasing products through jaggerestilistas.com.
They apply to purchases made directly through this website. Purchases made through third-party marketplaces or platforms may also be subject to the conditions and procedures of the relevant platform, without prejudice to the consumer's mandatory statutory rights.
Nothing in these terms is intended to exclude or restrict any mandatory consumer rights under applicable law.
3. Products and product information
JAGGER ESTILISTAS mainly sells professional hairdressing, cosmetic and hair-care products.
The essential characteristics, presentation, quantity, available options and other relevant information for each product are described on the corresponding product page.
Photographs and graphic representations are intended to display products as accurately as reasonably possible. Manufacturers may occasionally alter packaging, design or presentation without necessarily changing the nature, quantity or essential characteristics of the product.
Before completing the order, customers should check that they have selected the correct product, format, shade, colour, size, quantity or variant.
4. Product availability
All orders are subject to product availability.
If, after an order has been placed, a product is unavailable, JAGGER ESTILISTAS will inform the customer as soon as possible and, as appropriate, refund the amounts paid for the unavailable product or offer an alternative which the customer may freely accept or reject.
A materially different product will not be substituted without the customer's consent where the substitution changes the essential characteristics of the product purchased.

8. Payment methods
Customers may use the payment methods enabled and displayed during checkout.
Available methods may include payment by bank card through a secure payment gateway and PayPal, as well as any other payment methods that JAGGER ESTILISTAS may make available.

9. Shipping and delivery

As a general rule, orders are prepared for dispatch within 48 hours following confirmation of payment, except in exceptional circumstances, product unavailability, non-working days or where a different timeframe has been indicated.
Where supported by the carrier, tracking information will be provided so that customers can follow the shipment.
Delivery estimates shown during checkout correspond to the selected service and may be affected by circumstances outside the reasonable control of JAGGER ESTILISTAS. In all cases, unless another delivery period has been agreed, the order will be performed without undue delay and within the limits established by applicable law.
The customer must provide a complete and accurate delivery address. Delays or costs resulting from incorrect or incomplete information supplied by the customer may be attributable to the customer where legally appropriate.

10. Receipt of orders and delivery issues
Upon delivery, customers are advised to check that the parcel and products received are in appropriate condition.
If the parcel is visibly damaged, products are missing, an incorrect item has been received or any other issue is identified, the customer should contact JAGGER ESTILISTAS as soon as possible. Photographs of the parcel, shipping label and products may be requested where reasonably useful for handling the claim.
This recommendation to report delivery issues promptly does not restrict the customer's statutory rights.
11. Right of withdrawal
Where the purchaser qualifies as a consumer, they generally have 14 calendar days to withdraw from a distance purchase without giving any reason.
For goods, the withdrawal period is calculated in accordance with applicable law from the day on which the consumer, or a third party designated by the consumer other than the carrier, acquires physical possession of the goods.

Use of the withdrawal form included below is not compulsory, provided that the communication clearly expresses the decision to withdraw from the contract.
12. Returning goods after withdrawal
After notifying JAGGER ESTILISTAS of the withdrawal, the consumer must return the products without undue delay and, in any event, no later than 14 calendar days after communicating the decision to withdraw.
Unless JAGGER ESTILISTAS expressly agrees to bear them, the direct cost of returning goods following withdrawal will be borne by the customer.
The consumer will only be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
13. Exceptions to withdrawal and hygiene products
The right of withdrawal is subject to the exceptions established by applicable law.
In particular, the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons where they have been unsealed after delivery.
This exception will only apply where the statutory conditions are actually met. The fact that a product is a cosmetic or hair-care product does not in itself automatically remove the right of withdrawal.
Other statutory exceptions may also apply, including goods made to the customer's specifications or clearly personalised goods, and products liable to deteriorate or expire rapidly, where the relevant legal requirements are met.
14. Refunds following withdrawal
Where the right of withdrawal is validly exercised, JAGGER ESTILISTAS will refund all payments that are legally refundable, including standard delivery costs in accordance with consumer law.
If the customer expressly selected a delivery method more expensive than the least expensive standard delivery method offered, JAGGER ESTILISTAS is not required to refund the additional cost arising from that choice.
The refund will be made without undue delay and in any event within the statutory maximum period of 14 calendar days from the date on which JAGGER ESTILISTAS is informed of the decision to withdraw.
Unless JAGGER ESTILISTAS has offered to collect the goods, it may withhold the refund until the goods have been received or until the customer provides evidence that they have been returned, whichever occurs first.
Refunds will generally be made using the same payment method used for the original transaction, unless expressly agreed otherwise and provided that this does not cause the consumer to incur additional costs.
15. Faulty, incorrect or non-conforming products
If a product received does not conform to the contract, is defective or is not the product purchased, the customer should contact JAGGER ESTILISTAS so that the issue can be handled.
Consumers benefit from the rights provided under Spanish law concerning the statutory guarantee of conformity. For new goods, JAGGER ESTILISTAS is liable for lack of conformity existing at the time of delivery and becoming apparent within the statutory period of three years from delivery, subject to the provisions and exceptions established by law.
Where a lack of conformity exists, the remedies provided by law will apply, including, where appropriate, repair or replacement, a price reduction or termination of the contract.
Measures required to bring a product into conformity will be provided free of charge to the consumer where required by applicable law, including legally required associated costs.
The statutory guarantee is independent of any additional commercial warranty provided by the manufacturer.
16. Order cancellation and changes
Customers wishing to change or cancel an order should contact JAGGER ESTILISTAS as soon as possible.
If the order has not yet been prepared or dispatched, JAGGER ESTILISTAS will attempt to accommodate the request where possible. If the order has already been dispatched, the applicable withdrawal and return rules will apply where appropriate.
This section does not restrict the customer's statutory right of withdrawal where it applies.
17. Promotions, discounts and gifts
Promotions, discount codes, special offers and promotional gifts are subject to the specific terms communicated for each campaign, including, where applicable, duration, eligible products, minimum order values, availability and usage restrictions.
Promotions are subject to availability and may not be used fraudulently or contrary to their expressly stated conditions.
18. Personal data protection

20. Liability
JAGGER ESTILISTAS will be responsible for compliance with the obligations legally incumbent upon it as seller.
JAGGER ESTILISTAS will not be liable for delays or failures caused exclusively by circumstances outside its reasonable control where a lawful ground exists to exclude or limit such liability. Nothing in this clause may be interpreted as limiting mandatory consumer rights.
Customers must use products in accordance with the manufacturer's instructions, warnings, composition information, precautions and recommendations.
21. Applicable law and jurisdiction
These terms are governed by Spanish law and any applicable European Union legislation, without prejudice to mandatory consumer protection provisions applicable according to the consumer's place of residence.
Where the purchaser is a consumer, any dispute will be submitted to the courts having jurisdiction under applicable law, including the legally protected jurisdiction available to consumers.
These terms do not impose mandatory submission to the courts of JAGGER ESTILISTAS' place of business where such submission would conflict with applicable consumer law.
22. Changes to these terms
JAGGER ESTILISTAS may update these terms to reflect legislative, technical or commercial changes or changes in the operation of the online store.
Changes will not apply retroactively to orders already concluded. Each purchase will be governed by the terms in force and accepted at the time the order was placed, unless otherwise required by law.
